Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Lunara AI LLC's websites and services, including lunaradynamics.com and any related products (the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Changes to Terms

We may update these Terms from time to time. The updated version will be effective when posted. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

Eligibility and Accounts

• You must be at least 13 years old to use the Services.
• If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
• Provide accurate information and promptly update it when it changes.

Acceptable Use

• Do not use the Services for unlawful, harmful, or abusive activity.
• Do not interfere with or disrupt the integrity or performance of the Services.
• Do not attempt to gain unauthorized access to systems or data.
• Do not reverse engineer or copy the Services except as permitted by law.
• Do not infringe others’ intellectual property or privacy rights.
• Do not transmit spam, malware, or deceptive content.

Your Content and Customer Data

You retain ownership of content you submit or upload ("Customer Data"). You grant Lunara a limited license to host, process, transmit, and display Customer Data solely to provide and improve the Services and as otherwise permitted by these Terms and our Privacy Policy. You are responsible for obtaining all necessary rights to Customer Data and for its accuracy.

Intellectual Property

The Services, including their design, software, and content, are owned by Lunara or our licensors and are protected by intellectual property laws. Except for the rights expressly granted to you, no rights are transferred to you. You may not remove proprietary notices or use our trademarks without permission.

Third‑Party Services

The Services may link to or integrate with third‑party products. Those products are governed by their own terms and privacy policies, and Lunara is not responsible for their content or practices.

Fees

If you purchase paid features, you agree to pay applicable fees and taxes. Except where required by law, paid fees are non‑refundable.

Warranties and Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error‑free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNARA AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. LUNARA’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNTS YOU PAID TO LUNARA FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Indemnification

You will defend, indemnify, and hold harmless Lunara and its affiliates from and against any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

Termination

We may suspend or terminate your access to the Services at any time for any reason, including if you violate these Terms. You may stop using the Services at any time. Sections intended to survive termination will do so.

Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflicts of laws principles. The exclusive venue for disputes will be courts located in Delaware, unless applicable law requires otherwise.
